I guarantee they are going over tons of film at the clubs, checking credit/debit card purchases. If he was drinking they'll find out

It’s pretty strong circumstantial evidence. There are also reports that there are numerous cameras that captured both cars racing.

It’s all real evidence. Just because a single piece of information is not enough to justify a conviction, it doesn’t mean it doesn’t add to our overall understanding of what happened and would contribute to an eventual conviction, along with other pieces of evidence.
