Reply to comment by kilroy94 in Warrants out for arrest of Jalen Carter, ex-Georgia star and NFL draft prospect. by PrincessBananas85
If Jalen Carter wasn't also intoxicated and racing the driver who crashed, why did he flee the scene? why was he at the scene of the crash in the first place if he weren't also going 100mph?

None of that helps prove charges against him
Merpninja t1_jaiwpnf wrote
Your point? He is lucky to only be facing charges this minor. They are likely to get more severe before they are dropped.

I guarantee they are going over tons of film at the clubs, checking credit/debit card purchases. If he was drinking they'll find out

It’s pretty strong circumstantial evidence. There are also reports that there are numerous cameras that captured both cars racing.

The latter is real evidence potentially if math works right. The former wouldn’t be enough
Wayyyy_Too_Soon t1_jake660 wrote
It’s all real evidence. Just because a single piece of information is not enough to justify a conviction, it doesn’t mean it doesn’t add to our overall understanding of what happened and would contribute to an eventual conviction, along with other pieces of evidence.

I meant the former wouldn’t be enough on its own. I am a lawyer

Because he did a dumb thing, like I mentioned. Imagine the terrifying nature of all of this though. Going from the best day of your life to seeing what he saw. I won’t make excuses for him, but legally, this won’t have huge repercussions.
Merpninja t1_jaiscmx wrote
I hope he feels awful over this, but denying it completely after he fled the scene shows little remorse. And his other teammate that ALSO fled was charged with racing in a separate incident just last week. Don't act like they're learning anything from this.
Great players have dropped in the draft for far less.
kilroy94 t1_jaishe8 wrote
Who am I to say they haven’t? I understand your point, but again legally, these are misdemeanor charges
Merpninja t1_jaiu2r2 wrote
This isn't about the charges. It's about him seeing his teammate die in front of him, and his first reaction is to flee, lie to the police, and act like he wasn't there.
Stop with the "imagine your best night ever being ruined by your own actions :(((" type shit. I do not feel bad or sorry for him at all. The only thing this proves to the NFL teams scouting him is that he is a POS. It doesn't matter what he gets sentenced with in the end.

He incentivized and participated in the horrific death of his two friends.
It’s a time to take full responsibility.

I didn’t say a dang thing about his career or his talent. I simply said that that the charges aren’t as severe, right or wrong. The headline makes it sound like he’s going to jail, but he only has two misdemeanors against him. He’ll get a fine, and a slap on the wrist. The scrutiny will remain on the car that crashed and the people who lost their lives.

I'd like to hear a lawyers response about whether or not he could be held liable for the other cars deaths if it's proven he was drag racing them. I know from other crimes if someone dies while you're committing a crime with them you're held liable

Check those three articles. All three are cases in Georgia where street racers died, and the other racer was charged with vehicular homicide. Carter can and likely will be charged with vehicular homicide, along with a host of other charges.

Yeah but were any of them star football players from UGA? Because idk if I have so much faith in the execution if blind justice from a Georgia DA office.

Lawyer here! I too would like to hear the response of a Georgia lawyer who practices criminal law. First, it appears that the defendant has just been charged with misdemeanors. Without a felony charge, the Georgia felony murder statue does not come into play.
Here is the Georgia murder statute. Look at (c). Takeaway from this, obviously, have to commit a felony and cause a death.
Here is a succinct blog article on felony murder in Georgia. Takeaways from this, you can get a felony murder charge from the death of a co-defendant.
Here is a recent article in which a Georgian defendant was charged with felony murder and vehicular manslaughter in a case where street racing occurred. The person who died was the opponent driver. A key difference in this case is that both the defendant and deceased fled the police prior to the crash that lead to the death. Fleeing or attempting to elude may be the felony used to charge felony murder in this analogous case. It could also be an instance where the prosecutor is overcharging.
I’ve spent too much time thinking about this and should eat dinner…so…
Tl; dr: maybe? There is a recent analogous instance where someone was charged with felony murder stemming from a race where the opponent racer died. I’m not sure what felony they’d charge to get to felony murder in the present case. Reckless driving and racing appear to be capped as misdemeanors in GA. I think you should ask a lawyer.
