Earlier today, I reported a large leak in our parking garage down in our basement. After that report was filed, apparently our maintenance department turned off the water lines to the radiators. Since then, the temperature in my apartment has dropped sharply. I was wondering if there are any specific laws or ordinances that I could cite if the issue was not fixed promptly?

I saw a mention of something are not made on an urgent request within 24 hours, or less urgent requests, within 30 days, that a tenant could withhold rent, on palawhelp.org and turbotenant.com, but was unsure of where to look for something more specific.

Your landlord is obliged to keep your space “habitable,” which, among other things, means your primary living spaces need to be heated to 68F if it’s 10F or more outside, or 61F if it’s below 10F out. If they fail to do that, they can be reported to the health department for failing to provide a habitable unit.

I say this not because you should immediately jump to calling ACHD, but so you know what the backup plan is if your landlord doesn’t fix the issue. If your landlord knows you’ll be without heat for a bit (and if they haven’t scheduled a service appointment yet, they know), they should be providing you an alternate means of heating. Usually that’s going to be bringing over some space heaters, but it could also be something like putting you up in another property or a hotel or something if space heaters aren’t an option for some reason.

Call your landlord and ask for space heaters or some other solution. If you run into resistance, let them know the law says they have to. It’s entirely possible your landlord may not know the law. If they do know the law but are trying to skate it, now they know that you know your rights. Don’t be threatening or shitty about it until you absolutely have to.

Even if you wanted to withhold rent, unless your rent is literally due tomorrow, or in the next couple of days, it's not going to matter. You have to allow a landlord a reasonable amount of time to diagnose and fix an issue before you can withhold rent, and it sounds like they're already working on it. This weather has caused issues for a shitload of people, and I'm sure the repair guys are swamped, right now, so most people aren't going to be able to get things fixed the same day.

Instead of trying to learn how to threaten to withhold rent, why don't you try asking your landlord to get you some space heaters since the radiators aren't working? You've already admitted that they've acknowledged the issue, and are working to get it repaired.

I realize I’m probably jumping the gun with it, but I’ve just had problems with this particular management either taking 3 months to fix something or just completely ignoring a maintenance request.

If the whole building is running on boiler heat and it is leaking from an unknown location he has to shutdown the entire system to diagnose and fix the problem or risk fucking up the boiler then you would be in for a real wait.

Might do that. They did tell me that they’re trying to get to Climatech to come fix heating, but that they haven’t been able to get through to them. They also apparently are having a plumbing company coming to fix the leak down to the garage.

They need to turn on the lines and deal with the basement.

My apartment has been cold as fuck but I’m not about to give shit to the maintenance guys on Christmas. That said, they’ve been historically responsive to stuff.
