Merrick Garland is going to wait until the results of the 2024 election, and if Santos loses, Garland will open a probe and promptly close it come January 2025.

20

RyVsWorld t1_j5675pi wrote

Doubt he’ll do that. Garland is a coward and is afraid to hold politicians accountable

Topher1999 t1_j56ftu4 wrote

Merrick Garland simply won’t do anything. He’s essentially Robert Mueller.

The last time we did something, like hold a free and fair election, there was death at the capital. Seems like it worked to an extent.

Only hope is Brazil issues warrant for his arrest although I'm sure the Republicans will still try to find a loophole.

  1. we have a treaty with Brazil

  2. here is a write up on how it may work: https://cis.org/North/Extradite-Rep-Santos-Brazil

Beerbonkos t1_j560w8e wrote

I don’t think we have an extradition treaty with Brazil

5

No extradition treaty. It won't matter at all. Republicans won't even respond.

pixel_of_moral_decay t1_j57ladv wrote

That’s historically very conditional and political.

Many countries reject all American requests simply because the death penalty isn’t banned. Or because our appeals process is too complex/expensive.

No chance someone in office is extradited. That’s an easy one to deny.

1

tinydancer_inurhand t1_j57likn wrote

But this is the other way around. Brazil is asking for the USA to give Santos back. Santos isn't in danger of the death penalty.

If the USA was asking for Santos then Brazil can say no cause of the death penalty.

3

pixel_of_moral_decay t1_j57lr0e wrote

US can just say “human rights” which for Brazil’s legal system is a realistic complaint.

0 chance he’d get extradited. Odds are low even for an ordinary citizen unless there’s a high value arrest we want in exchange. For a politician in office? 0.

2

tinydancer_inurhand t1_j57m10e wrote

Ok but the original comment i was responding to was that there is an extradition treaty. They said there wasn't.

Whether it happens or not is another conversation. That's a debate on how Biden and Lula would handle it.

It's a purple district. A special election is an almost certain win for Dems, flipping a seat in a very close house. No way Santos leaves on his own and very little chance he is forced in the next two years.

I'm in his fucking district and it was a tight race... You are correct it will flip blue if he leaves.

If this were a solid red district republicans would have kicked him out weeks ago.

Why? When have they held anyone on their team to any kind of standard? I'll take serious answers. Republicans actually gave this guy committee seats

EdgeOrnery6679 t1_j56u5q9 wrote

Because they would have easily replaced him with another Republican that's not controversial. If New York was a swing state, Democrats would have left Cuomo alone instead of making him resign to easily replace him with another Democrat.

DJBabyB0kCh0y t1_j56ek1z wrote

We're talking about the Nassau County republican party. Theyve called for his resignation, probably knowing it won't happen. But they were pretty aggressive. The RNC which he is now beholden to is far different.

PandaJ108 t1_j55egtw wrote

If he gets arrested, which I think its highly likely, does that mean automatic remove from congress? Or would the house still have to do their procedure to remove him?

With all the lying he has done. I would be shocked if those campaign funds did not involve some criminal element.

8

tinydancer_inurhand t1_j55r4tm wrote

Congress reps have been indicted for fraud before. I believe they usually step down.

8

Rottimer t1_j560xpf wrote

No, it’s not automatic. Unless he resigns, they’d have to vote to kick him out. Worse, if by some miracle they arrest and convict him - but Republicans don’t kick him out and he doesn’t resign, he could probably argue to a judge that he needs to be released each day to do his job in congress and stay in jail at night or when congress is otherwise out of session.

Sentences to get deferred for various reasons. Judges have that discretion.
