I'm fairly certain that the constitution, and it's amendments, would apply only to government agencies. Unless the Super Hero is on a government payroll, nothing he does is bound by the constitution.

it doesn't, as the bill of rights is about limiting the government and agents of the government, not the citizens.
For anyone writing on this prompt, for most accuracy, said superhero should be an agent of the government - whether law enforcement or otherwise.
