I work for a small company that I believe to be responsible for a plethora of L&I, Food/Health Department, and OSHA violations. I will not be able to iterate through each individual violation, as this will become a 1,000+ word essay. I am currently a manager of the company and have access to a number of different data points. These span from 12.23.21 to today, 02.03.23.

The 'major' ones that I have experienced first hand would be the following;

  1. Wage Theft: Timecards have been edited without employees consent or knowledge. In some cases I found this to be a 20% reduction in that pay period. I also have a paycheck that is less than the paystub amount. This same paystub has less hours reported than the timecard keeper. I have screenshots from the POS timecard keeper, I have all employees timecards exported, and I have GPS information, via Google Timelines.
  2. Meal/Rest breaks: There is no record of 30 minute unpaid breaks in the last year of ALL employees timecard history. This goes hand in hand with wage theft, because the employer has taken the time out of employees wages. Whether they have taken the break or not.
  3. OSHA: Attached, yes that is an electrical panel.

As a manager I feel it is my responsibility to take care of my fellow co-workers. I have been gathering information from my co-workers and I believe them to all be affected. More specifically the breaks and wage thefts. Given the frequency of these violations, I do not believe them to be in error. A pattern is consistent, an error is sporadic.

I am seeking guidance on my next step. I strongly believe that I need to talk to lawyer but I am unsure. I am upset that myself and co-workers have missing wages but I am more concerned about future employees that may be unaware. I want it to stop more than I want retribution. Just to add some sugar, recently a co-worker has also confided in me that they are actively in the process of pressing sexual harassment charges against this employer. They no longer work with us.

if what you say is true, this is both a state and federal crime.

you should document and report to L&I immediately, and should also consider reporting to the IRS.

then expect all hell to rain down.

and retaliation. make sure you have all your evidence together and well documented as the company will likely try to separate you quickly.

Please file an osha complaint and a wage theft complaint. Asap!

Most states have a wage theft form you can fill out and submit. The u.s. gov should have one as well.

Osha, start documenting what is wrong and file a complaint. Let they be ligeit and valid enough for them to come out. I called the 800# and asked about a few minor issues and they said they were questionable unless they turned into a larger issue. Your issue is valid enough.

L&I does the electrical certifications too. I’m sure they would love to see the “electrical panel”

You should certain report this right away.

My employer had to have settlement in King County Court last summer for something less harmful but still costly to them. In my case they did not compensate employees for the five minutes it took to log into their computer systems so now we are paid for five minutes pre-shift every day and had a check and tax forms mailed to us.
