Doesn't matter when they said they'll do it, its past the date where it is required so they can will and are getting sued

Technically correct, but a moot point means something no longer matters. The remedy a judge would impose is to certify the election. It’s Wednesday now, so unless the judge hears this case before the board meeting the election will already be certified.
